General Terms and Conditions for booking at PatagoniaChic.com®
This Terms and Conditions statement constitutes a legal agreement between the user and PatagoniaChic.com®. By using the services of PatagoniaChic.com®, you acknowledge that you have read, understood, and accepted the terms set forth herein.

All access to and reservation of any service through PatagoniaChic.com® is subject to the terms and conditions established by the website. By using PatagoniaChic.com®, you agree to comply with these terms at all times. Therefore, it is the user's responsibility to carefully read the Terms and Conditions before making any reservation through PatagoniaChic.com®, as well as any specific conditions that may apply to their purchase. Additionally, modifications to the General Conditions may affect certain services, and users are responsible for reviewing them, as they may have changed since their last access to the website.

The user declares that they are of legal age and have the legal capacity to purchase the services offered through PatagoniaChic.com®.

Access to the website is prohibited for users residing in jurisdictions where its content is not authorized.
Contracting services through the PatagoniaChic.com website
This Website is intended for end consumers only and may be used solely for the purpose of obtaining information and making purchases through it. Any other use is prohibited without the express written consent of the owner of PatagoniaChic.com®. Without limitation, the following actions are not permitted:

a) Using the Website in violation of applicable laws, good faith, generally accepted practices, or public order.

b) Using the Website for purposes that may harm PatagoniaChic.com® or any third party, or that may in any way damage, disable, or interfere with the normal operation of the Website.

c) Introducing into the network any programs capable of causing damage to the computer systems of PatagoniaChic.com®, the company providing the tourism or travel services (hereinafter the “Service Provider”), suppliers, or third-party users of the internal network or the Website.

d) Including information from PatagoniaChic.com® in comparative price search tools.

e) Accessing the Website through robots, spiders, or any automated search tool or program.

f) Conducting mass searches that are disproportionate to the purchases made through the Website.

g) Making speculative, false, or fraudulent requests or bookings.

Notwithstanding the foregoing, PatagoniaChic.com® reserves the right, at any time, without prior notice and without any right to compensation, to deny access to the Website to any users who fail to comply with these General Conditions or with any specific conditions applicable to them. If PatagoniaChic.com® has reasonable grounds to believe that an order has been placed in violation of these General Conditions, it shall be entitled to cancel such order and may notify the relevant authorities. Users should be aware that the purchase of the aforementioned services is governed by the specific contractual terms and conditions applicable under the relevant legislation in each case, as agreed between the Users, the Service Provider, and PatagoniaChic.com®.

In particular, the following conditions shall apply generally:
Responsibility of PatagoniaChic.com
Unless otherwise indicated, any service offered by PatagoniaChic.com® through its Website is provided solely as an intermediary in the sale process. In other words, PatagoniaChic.com® merely facilitates contact between the Service Provider and potential customers. Therefore, PatagoniaChic.com® acts as an intermediary whose role is limited to concluding contracts on behalf of and for the account of the user on the one hand, and the Service Provider or organizer on the other. It does not assume, provide, or undertake to provide the services themselves. Consequently, PatagoniaChic.com® is not responsible for the non-performance or the proper and diligent performance of the services that are the subject of the contract between the Service Provider or organizer and the User.

Additionally, PatagoniaChic.com® accepts each and every one of the obligations or prohibitions that the legislation in force may impose at any time regarding the obligation, exclusion, or limitation of liability of the entire commercialization chain of the services in the fulfillment of the mediation contract.

In order for the User to have access to the comparison of requested services, the User expressly accepts that PatagoniaChic.com® may carry out, on their behalf, numerous procedures with the Service Provider in order to make such comparison between services possible.
Cancellations and/or Modifications
You may cancel or modify your reservation free of charge up to 1 day (24 hours) before the service start date.

If you wish to cancel or modify your reservation, you must contact us through the Customer Service Center at contacto@patagoniachic.com®.

The cancellation of your reservation more than 24 hours before the start of the service will not incur any charges. 100% of the amount paid will be refunded, always using the same payment method and currency chosen by the User in their original payment.

After the User requests the cancellation of the service in writing, PatagoniaChic.com® will cancel the reservation and proceed to issue the refund, sending the return receipt as proof. It is important for the User to understand that although the refund and return are processed immediately, the timeframe in which the User will see the amount credited to their account or card depends exclusively on their banking institution or the platform chosen to make the original payment. PatagoniaChic.com® is not responsible for refund processing times, which may take up to 45 business days depending on each banking institution.

In the event that the financial institution used to originally pay for the reservation (meaning the issuing bank of the buyer's credit or debit card or the platform chosen to make the payment) applies any type of fee for money reimbursement or uses an exchange rate different from the one applied during the reservation, PatagoniaChic.com® will not be held responsible for the application of these charges or rates, which are exclusive to the card-issuing bank or the platform used to pay, nor will it be held responsible for fluctuations in the foreign exchange market.

The modification of your reservation more than 24 hours before the start of the service will not incur administrative fees (no penalty will be charged for date changes; only in the event of a fare change, you must pay the price difference, if any) and will always be subject to the availability of the new requested date.

In the event that PatagoniaChic.com® confirms the modification of the reservation, the User will receive a new confirmation voucher with the updated service information. It is the User's obligation to verify that the information contained in the new voucher matches the requested service. No claims will be accepted for services different from those confirmed in the voucher. The reservation confirmation voucher is the only valid document detailing the services, dates, and times contracted.

In the case of cancellation or modification less than 24 hours before the start of the service, there will be no refund of the amount paid at the time of making the reservation, without prejudice to the events that may have led to the cancellation. Force majeure events described in section 9 of this contract are understood to be included within this timeframe.

In the case of partial cancellation or modification of a reservation, the same timeframes detailed above will be taken into account.

In the event of a no-show at the time of the service start, expenses of 100% of the reservation will apply, giving no right whatsoever to claim, even in the face of force majeure events.

To analyze any exception regarding the modification or cancellation of the reservation less than 24 hours before the start of the excursion (cancellation fee period), you may send a medical certificate up to a maximum of 72 hours after the start of the service. The medical certificate will only be accepted as valid to analyze the case if it is issued by a doctor from El Calafate belonging to a local medical institution (local hospital, local private clinic, or home doctor). Said certificate will be analyzed by the Service Provider, who will make a decision regarding the possibility of authorizing a cancellation, date change, or subsequent refund as an exception, having a period of up to 5 days to communicate this decision after the medical certificate is presented. In the event that the cancellation is approved free of charge, it will only apply to the value of the tickets of the persons referred to in the medical certificate or document presented to analyze the policy exception. No refunds or cancellations will be made for persons not referred to in the medical certificate or document presented.

The Service Provider may modify the start time of the excursion without the User's consent up to 12 hours before the start thereof, this not implying the alteration of the contracted service itself, nor any claim by the User due to the time modification.

In the specific case of the Minitrekking on Perito Moreno and Perito Moreno: Footpaths excursions, the standard start time may be rescheduled to a new start time up to 7 (seven) hours later than originally informed. This rescheduling will imply that the return time will also be modified by the same number of hours, not affecting the contracted service.
Claims Management
Before traveling, make sure to find out about any local events such as national holidays, public holidays, etc. that could affect the proper running of the service. In most cases, the final response to a claim will depend on the response time of the Service Provider, which is a maximum of 5 (five) business days.

To submit a claim, a written request must be sent to the Customer Service department at the email address contacto@patagoniachic.com, which will open a case and begin the appropriate proceedings.
Additional Information
The User is responsible for the economic consequences arising from the misuse of their data that the User or an unauthorized third party may carry out, preventing unauthorized third parties from accessing data that only the User should know, such as access to the email with the booking confirmation, access to the voucher, or access to their credit or debit card details.

A. Booking and confirmation process

To book a service on PatagoniaChic.com®, the User will be asked for the identifying details of each of the passengers who will take part in the activity, as well as to choose a payment method. Notwithstanding the provisions of these General Terms and Conditions, and in particular those relating to non-payment, the parties are not bound until the User successfully completes payment and receives the confirmation voucher. Up until and during the purchase process, the PatagoniaChic.com® system may alert the User to possible errors or omissions in the entry of required data, and the User may proceed to correct them. Once the purchase has been made, PatagoniaChic.com® is not responsible for any errors made by the User in data entry, without prejudice to the User's right to exercise their rights under personal data protection regulations. A confirmation email with the purchase information will also be sent to the User and archived by PatagoniaChic.com®. The User is obliged to review the confirmation voucher and, if it contains any error, must contact PatagoniaChic.com® immediately to correct it if possible.

The booking confirmation voucher is the only valid document detailing the services, dates, and times contracted. Claims for services different from those confirmed in the voucher will not be accepted.

When booking any service on PatagoniaChic.com®, at least one adult over 18 years of age must be included. Minors must always be accompanied by at least one adult to participate in any activity.

B. Booking payment

There are differentiated rates for Argentinians and foreigners. Prices for Argentinians with a local national ID (DNI) are those published in Argentine pesos on PatagoniaChic.com®, and prices published in dollars are valid for foreigners. You can view the rate according to your nationality by changing the currency on the website, or if you make a booking and the system identifies that you are not Argentinian and you are viewing prices in pesos, it will change the currency to dollars accordingly.

The purchase price of services provided by PatagoniaChic.com® is subject to continuous market fluctuations. In this regard, and unless a mandatory regulation or PatagoniaChic.com® expressly states otherwise, the User may terminate the contract with PatagoniaChic.com® or the Service Provider at any time, taking into account the cancellation or modification deadlines and their respective charges as set out in section 3 (Cancellations and Modifications) of this contract.

The User warrants to PatagoniaChic.com® that the credit or debit cards used are their own and that they have sufficient funds to cover the cost of the contracted service. The purchase of any service will only be effective at the moment PatagoniaChic.com® successfully charges the provided credit or debit card, or the payment amount is received by bank transfer. PatagoniaChic.com® reserves the right to cancel bookings made by the User in the event of non-payment, chargeback, declined card, false information, or if PatagoniaChic.com® is unable to verify the card details.

PatagoniaChic.com® reserves the right to request additional information from the User in order to verify their purchase.

Requesting a booking implies the User's commitment to authorize the charge to the credit or debit card provided. In the event that the charge to the credit or debit card cannot be processed (rejected transaction), the User should be aware that since payment has not been confirmed, the booking may be cancelled by PatagoniaChic.com®.

Prices listed on PatagoniaChic.com® include local taxes and are final prices. They do not include National Park entrance fees, lunches (where required for each particular service), or beverages for those services that require them, except in cases expressly mentioned on the Website.

PatagoniaChic.com® is not responsible for the payment methods accepted by National Park authorities, Service Providers, or any other organization that may be involved in the full delivery of the service. PatagoniaChic.com® will inform the User of auxiliary, complementary, and in some cases mandatory services that form part of the main service offered on the PatagoniaChic.com® website and in the voucher. Such rates may change between the time of booking and the time of service delivery, and PatagoniaChic.com® is not responsible for these fluctuations. Any variations in the applicable rate due to delays in booking payment will be passed on to the User.

C. Booking confirmation

After successfully completing payment, the User will receive the booking confirmation, which will include the service confirmation voucher with all information relating to the booking. It is the User's obligation to verify that the information contained in the confirmation voucher matches the service requested. Claims for services different from those confirmed in the voucher will not be accepted. The booking confirmation voucher is the only valid document detailing the services, dates, and times contracted, and may be required as a mandatory document to access the service on the day of the activity.

Furthermore, PatagoniaChic.com® has a maximum period of 24 hours after sending the confirmation to the User to modify or cancel any booking due to last-minute availability fluctuations related to market demand.

In such cases, the User will be informed within a maximum of 24 hours that the reserved spots are not available for the selected date or time, and the option to reschedule or cancel the booking free of charge will be offered.

D. Personal data

The User commits and takes responsibility for ensuring that their data and the data of any third parties they include is provided correctly and accurately through the PatagoniaChic.com® Website or our Customer Service Center, that they have the authorization of such third parties to provide it, that they have read and accepted these General Terms and Conditions and, where applicable, the particular conditions, that the data is true, accurate, complete, and correct, and that passenger names match exactly those appearing on their passport or national ID. PatagoniaChic.com® shall not be held responsible for any breaches of these obligations by the User.

If there is any change in the data provided or any error in the data held by PatagoniaChic.com®, it is the User's responsibility to provide the correct information.

All travelers, including minors, must carry the documentation required by law or authorities, such as a passport, national ID, etc. It is the traveler's sole responsibility to be informed of the documentation required for international border crossings.

For excursions involving international border crossings when traveling with minors, the documentation required by Immigration authorities must be carried, as well as documentation proving travel with both biological parents, or a notarized authorization to leave the country in the presence of only one parent.

The family record book is not a valid identification document for travel.

E. Excursion restrictions

When booking a service, the User understands and accepts its specific requirements for proper completion. On PatagoniaChic.com®, each particular service contains an information module referring to the necessary requirements that must be met in order to participate in the activity. It is the User's obligation to read the section relating to specific requirements and comply with them in order to take part in the activity. The Service Provider may refuse to provide the activity if all requirements listed on the excursion page are not met, and the User shall have no right to a refund if any of them are not fulfilled. By way of example but not limitation, this section includes age limits, physical conditions (heart conditions such as having stents or taking anticoagulant medication, knee, hip, or back problems, among others), motor, mental, or disability-related conditions, eating disorders, recent surgeries (understood as: within the 6 months prior to the activity date), overweight (understood as: a body mass index above 30), etc., that may prevent participation in the activity. If the User has any condition that prevents participation in the activity and this impediment was expressly indicated before booking through the Website, there will be no possibility of any subsequent claim or refund of the amount paid.

For some excursions, the Service Provider may request the completion of a medical form to verify that all necessary requirements are met, and this will have the nature of a sworn statement. The medical form will be requested from the User in the service confirmation voucher. It is the User's obligation to complete it at least 24 hours before the start of the service so that, in the event that for any reason a requirement for the excursion is not met, the booking can be cancelled without penalty.

Any incident of any kind arising from the User's failure to fulfill their obligation to manage, process, and provide the required documentation will not be assumed by PatagoniaChic.com®.

F. Accepted accommodations

PatagoniaChic.com® can only pick up passengers with its vehicles from accommodations that are registered with the local Municipality and also have permanent reception. Passengers cannot be picked up from private residences, unregistered accommodations, or those without permanent reception, such as Airbnb-type accommodations.

If staying at an unregistered accommodation or one without reception, a meeting point will be provided to begin the excursion.

G. Service organization and delivery

PatagoniaChic.com® does not offer the possibility of reserving a seat in advance on any of the transport it uses, whether land or water-based. Seating on each service and transport will be allocated on a first-come, first-served basis at the meeting point, or according to the vehicle's itinerary on the day of the activity, with PatagoniaChic.com® retaining discretion over the best organization of the route.

Since the services offered by PatagoniaChic.com® are group-based, the User must respect the schedules communicated by the Service Provider for presenting themselves at certain locations (by way of example but not limitation: the time and place of presentation for the start of the excursion, the time and place of meeting at an intermediate point, or the time and place of return). If the User is not present at the stipulated place and time, it will be considered a breach of contract by the User and PatagoniaChic.com® may unilaterally terminate the contract. This situation will not entitle the User to make any future claims.
Browser and Operating System
PatagoniaChic.com® makes every effort to avoid any errors in the content that may appear on the Website. However, PatagoniaChic.com® is not responsible for information that the User may obtain through links to external systems that are not under the control of PatagoniaChic.com®.

Additionally, PatagoniaChic.com® makes reasonable efforts to keep the Website up to date and in good working order. However, PatagoniaChic.com® does not accept responsibility for or guarantee that access to the Website will be infallible, continuous, or free of deficiencies. Nor can it guarantee that the content or software accessible to the User through the Website will be free from harmful elements, viruses, interference, faults, omissions, disconnections, or other elements that may cause damage or harm to the User, or alterations to the User's software or hardware computer systems or their electronic documents and files.

Likewise, PatagoniaChic.com® shall not be liable for damages of any nature arising from the use of the Website, including but not limited to those caused to computer systems, those resulting from improper use of the Website, interruptions or defects in telecommunications that may occur during financial or similar transactions, or those caused by third parties through illegitimate interference beyond the control of PatagoniaChic.com®.
Electronic Billing
For the purposes of this regulation on electronic invoicing, the User who makes a purchase gives their express consent to the sending of the invoice in electronic format by PatagoniaChic.com®, as applicable. This service will not entail any additional cost for the User.

In the event that the User wishes to receive a duplicate copy in paper format, it will be issued and will include shipping costs to the required destination, and may be requested by sending an email to contacto@patagoniachic.com
Intellectual Property
The intellectual property rights of the Website, its source code, design, navigation structure, software, databases, and the various elements contained therein are owned by PatagoniaChic.com®, which holds the exclusive right to exercise the exploitation rights thereof in any form and, in particular, the rights of reproduction, modification, distribution, public communication, assignment, making available, and transformation.

The intellectual property rights and trademarks of third parties must be respected by anyone who accesses the Website. PatagoniaChic.com® acknowledges the corresponding intellectual property rights in favor of their respective owners, and their mere mention or appearance on the Website does not imply the existence of any rights or liability in respect thereof, nor does it constitute endorsement, sponsorship, or recommendation.

For the purposes of preserving any intellectual property rights, in the event that any User or third party considers that a violation of their legitimate rights has occurred due to the inclusion of certain content on the Website, they must notify PatagoniaChic.com® of such circumstance, indicating:
- Personal details of the interested party.
- The holder of the allegedly infringed rights.
- Documentation validating and proving ownership of the allegedly infringed content.

In the event that the claim is submitted by a third party other than the interested party, they must provide proof of the representation under which they are acting.
- Identification of the content protected by intellectual property rights and its location on the Website.
- Sufficient proof of intellectual property rights.
- An express declaration in which the interested party takes responsibility for the accuracy of the information provided in the notification.
Force Majeure
PatagoniaChic.com® shall not be liable for non-compliance or external costs incurred by the User for services not contracted with PatagoniaChic.com, or for damages and losses caused as a result of force majeure, fortuitous events, or coercion, including but not limited to: strike, labor dispute, riot, terrorist attack or threat, terrorist activities, civil disturbances, industrial disputes, natural disasters, adverse weather conditions, hurricane, earthquake, fire, flood, snowstorm or windstorm, explosion, storm, subsidence, epidemic or pandemic, impossibility of using aircraft, motor transport, or other public or private means of transportation, impossibility of using telecommunications systems, unforeseen breakdowns, transport accidents, etc.
Partial Nullity
Due to the decentralization of the legislative function and control of the legal framework governing the activities carried out by travel agencies, it is possible that the General Terms and Conditions may be subject to various jurisdictions or regulations. Therefore, in the event that any condition of the General Terms and Conditions were to be null or voidable, the validity of the document as a whole shall not be affected by such circumstance.

The legally ineffective condition shall be replaced by a new one, or interpreted in a legally acceptable manner, that is as close as possible in substance to the condition that would have been formalized had the parties been aware of the ineffectiveness of the condition in question.
Enforceability
The fact that PatagoniaChic.com® does not require the User to comply with any condition of the General Terms and Conditions on one occasion shall in no way affect its right to require compliance on a subsequent occasion, or the right of any other party to require such compliance.

Any waiver by the User of any of the rights or powers derived from the General Terms and Conditions must be made in writing. The failure by PatagoniaChic.com® to require strict compliance with any condition shall not under any circumstances be considered a waiver, nor shall it deprive PatagoniaChic.com® of the right to subsequently require strict compliance therewith.
Lowest Price Guaranteed
If after booking an excursion on our website you find the same excursion at a lower final price on another website, you may request a refund of the difference, subject to the following conditions:

1. You must send us the link to the other offer through our contact channels (for example, email or WhatsApp) so that we can verify it.

2. The other website's offer must still be available online and bookable at the time we carry out the verification.

3. The offer must correspond exactly to the same excursion, on the same date (and time, if applicable), with the same included services and the same payment, modification, and cancellation conditions.

4. The price you are comparing must be the final price, including all taxes, fees, handling charges, and any other mandatory costs.

5. The guarantee does not apply to non-public rates or offers, such as corporate or business rates, closed group prices, personal promotional codes, loyalty programs, discount cards, or offers linked to packages or coupons.

6. We reserve the right to reject the request if all of the above conditions are not met or if we are unable to verify the alternative offer at the time of verification.
Transfer from El Calafate airport
The transfer from El Calafate airport to the city's hotels is a free service offered by PatagoniaChic.com® with the booking of any of its excursions in El Calafate.

To access this complimentary service, the following requirements must be met:

a. Having at least one excursion booking in El Calafate with PatagoniaChic.com®. Passengers who wish to take the transfer from the airport to El Calafate but do not have an excursion booking with the company will not be entitled to access this benefit, but may pay for the service at the current price.

b. Having made the excursion booking at least 48 hours prior to the start of the excursion. In the case of booking an excursion within 48 hours of its start, due to it being a last-minute booking and for operational reasons, PatagoniaChic.com® does not guarantee that the transfer service from the airport to El Calafate can be provided. However, alternatives will be sought to provide the service within the possibilities the company can offer the passenger. In the event that a flight is rescheduled or a previously coordinated transfer service is modified within 48 hours prior to the start of the excursion, the same conditions will apply.

c. PatagoniaChic.com® only covers the one-way transfer from El Calafate airport to accommodations in the city located within a 5 km radius from its center.

d. Only the one-way transfer service from the airport to El Calafate accommodations is covered. The return transfer to the airport is not included, nor is the possibility of substituting this service for a different one of interest to the passenger.

e. Upon arriving at El Calafate airport, it is the passenger's obligation to locate PatagoniaChic.com® staff in the arrivals hall and announce their presence in order to be identified. Company staff will be in the arrivals hall holding a sign with the "Patagonia Chic" logo, waiting to receive passengers from each flight. If the passenger has not announced their presence within 10 minutes after the completion of disembarkation and baggage collection for a flight, it will be considered a no-show, and the passenger will have no right to make any subsequent claim, even in the event of fortuitous or force majeure circumstances.
